Circumstances
beyond the control of City West Accommodation
(Force Majeure).
Except where otherwise expressly stated in these
conditions, City West Accommodation
and the property
owners shall not
be liable, jointly or individually, for any
changes, cancellations, effect on your holiday, loss or damage
suffered by you or for any failure by the accommodation
providers
to
perform or properly perform
any of their respective obligations to you which is due to
any event(s) or circumstance(s) beyond the reasonable
control of
the accommodation
provider concerned (referred
to as ‘force majeure’ in these conditions). By
way of example, force majeure includes fire, flood, exceptional
weather conditions,
epidemics, destruction, acts of terrorism
or damage of accommodation by any cause (other than negligence
of the accommodation provider) and all similar situations.
In appropriate
cases (for example
where your booking has to be cancelled before departure)
we on behalf of the accommodation
provider will, however, refund to you all monies paid to
us by you for the accommodation affected.
No compensation, expenses, costs or other sums of any description
(including without limitation the cost of securing alternative
accommodation)
will be payable in such circumstances by either the accommodation
owner or City
West Accommodation. We will endeavour to find you accommodation
in the same area of an equal or better standard.

Our
responsibility to you for your Booking
As we have our own properties and act as a booking agent we have
no liability for any of the accommodation arrangements (including
any
shortcomings
or
defects
with or
in any accommodation) and no liability for
any illness, personal injury, death, damage or loss of any kind,
unless caused
by
our negligence or that of any employee of
ours (providing they were at the time acting in the course of their
employment).
We cannot accept any liability for any act(s)
or omission(s) of the accommodation providers or anyone representing,
or employed by, the accommodation providers. Please also
refer
to Section
1 (Force Majeure) above. Any claim arising
from your stay in the accommodation and/or the act(s) and/or omission(s)
of the
accommodation provider or any employee of
the accommodation
provider must be brought against the accommodation
provider directly The accommodation provider shall have no liability
for any illness, personal injury, death,
damage or loss of any kind unless caused by the accommodation provider’s
negligence or that of any employee of the
accommodation provider (providing they were at the time acting
in the course
of their
employment).
You must take all necessary steps to safeguard
your personal property. No liability is accepted
by City West Accommodation
or the accommodation provider in respect of damage
to, or loss of, such
personal property except, in the case of
the accommodation provider, where the damage or loss is caused
by accommodation
provider’s negligence or that of any
employee of the accommodation provider (providing
they were
at the
time acting
in the course of their employment) or, in
the case of City West Accommodation, where
the damage or loss
is
caused by the negligence of City West Accommodation
or its employees (providing they were at
the time acting in the course of their employment).
For
any claim
made against us which does not involve death,
illness or injury, any liability we have
is in any event limited
to that provided by the courts in the jurisdiction
of
the state of Western Australia.
Arrival and Departure
So
as to allow time for the apartment to be cleaned, guests
are advised that check-in time is 2.00pm and departure time
is on or before 10.00am. By prior arrangement early check
in or late check out is available at $10.00 per hour.

Booking Deposit
A
deposit will be required to secure any bookings,
unless otherwise stated. The balance is to be paid
on arrival.
Due to the
busy holiday season, bookings for the December,
January and Easter periods will require a deposit
of 25% with
the balance
payable at time of arrival or as request at the
time of booking.
A ‘Tax
Invoice’ receipt
is issued for all transactions.
Cancellation Policy
A
minimum of fourteen (14) days notice.
For long weekends, public holidays and Christmas or if the
stay falls over a long weekend, a minimum of twenty
one (21) days notice is required.
Cancellations made within 24 hours of arrival,
will be charged at 50% of the tariff for the duration
booked.
If the apartment can be re-let for the cancelled period, then
the cancellation fee will be refunded less an administration
fee of $40.00.

Check In / Check Out
Check
in time is 2.00 pm unless by prior arrangement.
Check out time is 10.00 am. Should you wish to extend,
please contact us on 1300 726 720 to confirm availability.
A late check
out fee may apply. There is no refund for early
departure.
Cleaning
Service Fee
Due
to the limited time available to our cleaning staff,
we must request that you do your dishes and leave the
apartment clean
and tidy or additional charge
of $55.00 will
apply. Should additional cleaning be required, monies will be deducted
from the cleaning deposit.

Consumables
A basic supply of toilet paper,
dishwashing detergent, washing machine powder,
hand soap, shampoo and shower gel is supplied. A convenience store is located
at
the
front
of
110 Mounts Bay Road. Alternatively a Woolworth’s
supermarket is located in the Murray Street Mall
in the city centre. There are many 24 hours delicatessens
in the central city area.
In Victoria Park there is a Woolwoths supermarket located
in the Park Centro shopping centre on Albany Highway.
Is it safe to send my personal information over the Internet to City West Accommodation?
City West Accommodation uses 128-bit SSL Encryption to secure pages with sensitive content. SSL stands for Secure Sockets Layer, and is the industry standard form of encryption, used to secure transmissions over the Internet. Encryption is the technology that scrambles information being sent along a network, rendering it useless if it is somehow intercepted. City West Accommodation uses SSL whenever a transmission includes sensitive or confidential information, such as credit card numbers, addresses, phone numbers etc.
Description
The guest accepts that City West Accommodation has described the property
to the best of its ability and will not be held liable should the
property be deemed
unsuitable on arrival.

Governing Laws
The laws of the state of Western Australia, govern these terms and conditions.
You as a renter regardless of the situation of the property, or where
you are located, agree to submit to the jurisdiction of the courts of Western
Australia.
Guests Property
All
personal belongings, luggage, vehicles and other property
belonging to the Guest shall be the risk of the Guest at
all times and neither City West Accommodation
or the property owners accept any responsibility for any loss or damage
thereto.
Group Size
Under
no circumstances may the number of persons residing at the
apartment exceed the maximum number of guests
confirmed
at the time of booking. Should this condition not be
adhered to, additional charges will be incurred.

Insurance
You
are strongly recommended to take out adequate holiday insurance.
It is your responsibility to check you
have adequate insurance cover. The insurance should cover,
amongst other things, the cost of cancellation by you,
all medical costs and the cost of assistance including return
to your point of origin, in the event of an accident or illness.
Keys
Keys
will be available on the day of arrival unless
otherwise arranged. On departure please leave the
keys on the dining room table. The apartment
door closes and locks automatically. Exit by car is available
at
all times from the secure parking areas without an
access card.
Please note that lost or not returned keys (this includes
electronic access cards) will incur a replacement charge
of $25.00 per card.
Remote controls when issued will be charged at replacement
cost for those properties that require them.

Linen
Sheets, blankets, pillows, mattress protectors, towels, hand
towel, bath mat and tea towels are provided in
the apartments.
We provide quality bed linen in the apartments – please
do not allow massage oil to come in contact with
the sheets. Damaged sheets will be charged to your account.

We
are pleased to accept the following methods of payment:

Parking
Guests must only park cars in the designated areas.
Power
and Cooling/Heating
Charges
for these services are included in the daily tariff. Long-term
tenancy (greater than 4 weeks) may be subject
to a daily usage value. This will be arranged at the time
of
booking.

Rates [Tariff]
Please note that our tariffs are subject to change and may
have a loading for public holidays and long weekends.
Tariffs will be confirmed on request for a quotation.
Security Bond
A
refundable security bond of $250.00 is payable for
all bookings. Pending a satisfactory
property inspection, bond monies will be returned by
electronic
transfer or mail
within three (3) working days.

Smoking
All properties are non-smoking. Any costs incurred with
removing tobacco odours and damage will be deducted
from your cleaning deposit. Suitable areas are provided
to smoke outdoors at all properties.
Swimming Pools
Where a property has a swimming
pool it will be open
during daylight hours. Swimming pools are available
for guest use. Glass containers and food are not permitted
in
the pool
areas. The pool does not have a lifeguard and
children under 15 are not permitted in the pool areas
unless supervised by an adult. Please respect the conditions
of entry posted
in the pool areas. Swimming pools may be closed during
cooler periods of the year.

Telephone
A
telephone is connected to each of the properties.
A weekly charge of $1.00 per day is made to cover the line
rental.
All call types, local, STD/ISD 1800, One 3, 1300, 190 are
permitted. This is a pre-paid phone service with the value
of calls made being
added to your account.
Incoming
calls are permitted at any time.
Your
Behaviour
When
you book accommodation through City West Accommodation,
you accept responsibility for the proper conduct
of yourself and your party during your stay.
The accommodation provider reserves the right at any time
to terminate
your
stay or that of any member of your party due
to your or their misconduct, where justified in their reasonable
opinion.
Full cancellation charges will then apply and
no refund
will be given. Furthermore, neither the accommodation
provider nor City
West Accommodation shall
be under any obligation whatsoever
to pay compensation or meet any costs or expenses
you may occur as a result of your stay being terminated.
If your
actions or those of any member of your party
cause damage to the accommodation in which you are staying,
you
must
fully reimburse the accommodation provider
for the cost of the damage before you end your stay. You
must also
indemnify us against any claim (including legal
costs) made against
us as a result.
